This Admission Partner Agreement (the “Agreement”) is between M.B. Patil Education (“M.B. Patil”, “we”, “us”) and the individual or organisation that registers as an admission partner (“Partner”, “you”). You accept this Agreement when you tick the agreement box during registration or KYC on the partner portal.
1. Scope
- You may guide students towards admission at colleges that have partnered with M.B. Patil and are shown to you in the partner portal (“Partner Colleges”). This programme covers on-campus admissions only.
- You join under one of two models. As a Referral Partner, you share a student's details and M.B. Patil counsellors handle counselling, campus visits, admission forms and follow-up. As an Admission Consultant, you guide the student yourself from enquiry to admission, with M.B. Patil's support.
- You act as an independent partner. Nothing in this Agreement makes you an employee, agent or legal representative of M.B. Patil or of any Partner College, and you may not sign or promise anything on their behalf.
- Your account is activated only after M.B. Patil verifies your details and KYC. We may decline or withdraw verification at our discretion.
2. Lead ownership and disputes
- A student is identified by their mobile number. The first partner to register a student with M.B. Patil owns that student for the admission cycle.
- If the same student is registered by someone else, the portal flags it and M.B. Patil reviews the evidence — first registration date, the student's consent and recorded activity — before deciding. The decision is recorded against the lead and is final for that admission cycle.
- You must register only genuine students who have agreed to be contacted. Registering students without their knowledge, or to block other partners, may lead to loss of ownership and termination.
3. Conduct
- Never misrepresent fees, seat availability, eligibility, approvals, rankings, scholarships or placements. Share only the information published by the college or provided to you in the partner portal, and make clear that final fees and admission decisions rest with the college or admission authority.
- Never guarantee admission or ask a student for any payment that is not a fee due to the college.
- Obtain the student's (and, for minors, a parent's or guardian's) consent before sharing their details with M.B. Patil, and tell them that their details will be shared with the college they are applying to.
- Use M.B. Patil and college names, logos and materials only as provided in the marketing kit, and only to promote admissions to Partner Colleges.
4. Commissions
- Commission is one-time per confirmed admission — it is not paid per semester or per year.
- Commission becomes payable only after the college confirms the admission and the fee is received. Whether a particular college, course or seat type is eligible, and the applicable commission, are the terms shown to you in the partner portal at the time you register the student.
- Payouts are made by bank transfer to your verified bank account. Tax deducted at source (TDS) is deducted as required by law and shown on each payout. If you are GST-registered, you are responsible for providing a valid GSTIN and complying with GST rules.
- If an admission is cancelled or the fee is refunded, commission for that admission is not payable, and any commission already paid may be recovered or adjusted against your future payouts, as set out in the terms shown in the portal.
- No commission is payable for students you do not own under section 2, or for admissions obtained through breach of this Agreement.
5. Confidentiality and data protection
- Student personal data is to be handled in line with the Digital Personal Data Protection Act, 2023 and our Privacy Policy. Collect only what is needed for the admission, use it only for that purpose, keep it secure, and do not sell or share it with anyone other than M.B. Patil and the relevant college.
- If a student asks for their data to be corrected or deleted, or withdraws consent, tell M.B. Patil promptly and stop using that data.
- Keep confidential any non-public information you receive through the partner portal, including commission terms, college arrangements and other partners' details, during and after your partnership.
- Tell M.B. Patil immediately if you suspect any student data has been lost or misused.
6. Termination
- Either party may end the partnership at any time by written notice, including through the portal.
- M.B. Patil may suspend or terminate your account immediately for misrepresentation, misuse of student data, fraud or any other breach of this Agreement.
- On termination you must stop representing yourself as an M.B. Patil partner and stop using M.B. Patil materials. Commission already payable for admissions confirmed before termination remains payable, unless termination is due to your breach in connection with those admissions.
7. Governing law
This Agreement is governed by the laws of India. Subject to any dispute-resolution process agreed in the final version of this Agreement, the courts in Maharashtra have jurisdiction.
8. Changes to this Agreement
We may update this Agreement. Each version carries a version number; the version you accepted is recorded against your account, and material changes will be notified in the partner portal and require your acceptance.
